Cherokee Tribe Sues Over Arkansas Anti-Casino Amendment
Voter approval of the revocation of a casino license in Arkansas has now prompted a lawsuit by Cherokee Nation Entertainment. Arkansas residents repealed a license for Pope County that many local residents opposed with 56% of the vote, and the amendment now requires local ballot initiatives for future licenses. The Cherokee have sued the state in federal court on behalf of a Pope County resident asking that the amendment be declared unconstitutional and for a temporary restraining order and preliminary injunction to keep the amendment from going into effect. Amendment Nixes Tribal Casino The Cherokees had previously been granted the Pope County license in June by the Arkansas Racing Commission, and also challenged the legality of the constitutional amendment before the vote. “Cherokee Nation Entertainment is firmly committed to protecting its constitutional rights, defending its lawfully issued casino license, and safeguarding the substantial investments it made in good faith based on the establishment of the Pope County casino license under Amendment 100 in 2018,” Cherokee attorney Bart Calhoun said in a statement following the vote. “Amendment 104 undermines foundational legal rights and stands to interfere with several binding contractual obligations.” Calhoun said the tribe was contesting the amendment on several legal fronts “to preserve our client’s rights and investments throughout the legal proceedings.” In 2018, voters approved Amendment 100 allowing for four casino licenses. Three of those were built but residents in Pope County expressed opposition to one being planned in the region. According to Oklahoma Voice, Cherokee Entertainment is challenging the amendment on the basis of due process, contracts, equal protection, and the takings clause of the U.S. Constitution. The tribe planned a $300 million facility in the county that included acquiring 325 acres to build the 50,000-square-foot Legends Resort & Casino. Proposed New Haven controversial casino holds vendor fair
NEW HAVEN, Ind. (WPTA) – Leaders at Full House Resorts, the company behind the proposed casino, held an information session for potential vendors if the casino gets approved. Ken Fries, an Allen County councilman and former Sheriff, says he supports the casino coming to New Haven because they will have to pay Allen County and New Haven in gaming taxes. “As a Councilmember for Allen County we’re always looking at ways to reduce property tax and I think that this is a good way to augment that property tax,” says Fries. A big criticism from people opposed to the casino is that it would possibly bring more crime to the area. Fries, being the former Sheriff of Allen County, was able to provide some insight on the concern. “Fort Wayne was looking at putting a casino in years ago and people were talking about all the crime that is associated with casinos. So, I took it upon myself to call the sheriffs in counties that had casinos in the state of Indiana and asked them ‘what kind of crimes have you seen an increase in.’ They said the only thing they’d seen an increase in was domestic violence. Otherwise it was great for their counties. They had more money, new squad cars, better streets, new buildings. They said it was a boom for their counties, and it was a positive not a negative.” Alex Stolyar, the Chief Development Officer for Full House Resorts, says the research shows jobs would be created. “They concluded this would create about 2,400 jobs in the area of Phase one. About 1,200 of those jobs will be working with us directly, another 1,200 with be indirect and induced through the economy working with our vendors, suppliers, and just in the general region,” says Stolyar. State Sen. Brown opposes New Haven casino development | Local
State Sen. Liz Brown on Tuesday said she opposes plans that would allow a casino to operate in New Haven. Brown, R-Fort Wayne, issued a statement less than 24 hours after another state lawmaker, Sen. Tyler Johnson, hosted a town hall meeting for New Haven residents. Full House Resorts, Inc., which owns, leases, develops and operates gaming facilities nationwide, wants to move an existing license from the Rising Star Casino in southeastern Indiana to New Haven. In 1993, the General Assembly legalized casino gambling and provided that the Indiana Gaming Commission would regulate and control the issuance of licenses. The law also required that casino gambling be approved by a referendum vote before a casino could be licensed to operate in local communities,” Brown, who represents the 15th district, said in an emailed statement. “If approved, gaming taxes are imposed on the revenue generated by the casino and are deposited into the state’s General Fund. For the past several years, gaming taxes have been one of the top five revenue sources for the state,” she said. “Simply put, these casinos exist to be a revenue producing organization, not an economic development project for the community.” Indiana lawmakers, who reconvene in January, would have to approve moving the casino operating license. Full House has said the casino development and resort in New Haven would represent an estimated $500 million investment. An economic impact study paid for by Full House and released this month shows the proposed casino would generate more than $80 million in annual state and local taxes and spark creation of more than 2,400 new jobs. The proposed development has prompted numerous to comment about the casino on social media. Facebook, for example, has at least one public group with nearly 535 members with a page administrator that seems to support the plan. Another Facebook page, “No CasiNO in New Haven,” is private and has nearly 285 members. Brown said in her statement Tuesday that there is a cost to the community where a casino operates, but it’s not “always measured in dollars.” All the costs need to be considered when determining where the casino should be located, she said. Even at an initial community meeting Full House hosted in late September in New Haven, some residents voiced concerns about demands in areas such as infrastructure and roads with the influx of traffic and visitors a casino development would likely attract. “After listening to constituents and interested parties in northeast Indiana, and particularly in the New Haven area,” Brown said Tuesday, “I am opposed to a casino being located in our area.” Source link
