LAS VEGAS, Nev. (FOX5) – A family has filed a wrongful death lawsuit against Excalibur after one person died due to a poolside incident.

According to court documents, on June 15, 2023, Paul Nakashima stayed at Excalibur with family and friends to celebrate his 16th birthday.

Later that evening, Nakashima entered the Court Pool through the pool steps. Nakashima slipped on one of the pool steps and hit his head in an area that was reportedly extremely shallow.

The lawsuit claims one lifeguard was in the area, but after the fall, the lifeguard on duty failed to check on Nakashima.

Nakashima sisters, Sandra Waithe and Ruth Nakashima claim Excalibur lifeguards did not follow the official aquatic emergency plan, policies, and regulations.

The lawsuit stated that around 4:20 p.m., guests noticed Nakashima was floating with his head underwater and alerted the lifeguards on duty. The lifeguard jumped in to pull Nakashima out.

The lifeguards failed to sweep the pool for danger before jumping in and failed to utilize a backboard while attempting to render aid, which is required by Excalibur’s lifeguard instructions, according to the lawsuit.

Nakashima’s brother-in-law assisted the struggling lifeguard in pulling Nakashima to the pool’s edge.

When they finally pulled Nakashima out of the water, he was unresponsive, and his face was blue. A guest with EMT experience provided CPR aid, and then two Excalibur security officers arrived.

According to the report, the medical equipment needed was not in the pool area.

LVMPD reported to the scene and attempted CPR but were unsuccessful.

Paramedics arrived slightly over 10 minutes after Nakashima was spotted with his head underwater and taken to Spring Valley Hospital.

The court document revealed a medical professional told Nakashima’s family that he was “deprived of Oxygen for over 45 minutes and would not recover,”

Clark County Coroner ruled the death due to complications of near drowning.

Nakashima’s family is seeking $15,000 in relief for the damages caused by Excalibur’s negligence in lifeguard training and supervision, which they claim led to Nakashima’s death.
